1. ACCEPTANCE OF TERMS

By accessing, browsing, or using PacksMC (accessible at packsmc.com, hereinafter referred to as "the Platform", "the Service", "we", "us", or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must immediately cease all use of the Platform. We reserve the right to modify, amend, or update these Terms at any time without prior notice. Your continued use of the Platform following any changes constitutes your binding acceptance of such changes. It is your responsibility to review these Terms periodically.

2. ELIGIBILITY

You must be at least 13 years of age to use PacksMC. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the Platform with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms. By using our services, you represent and warrant that you meet these eligibility requirements. We reserve the right to request proof of age at any time and to terminate accounts that do not meet these requirements.

3. USER ACCOUNTS AND AUTHENTICATION

To access certain features of the Platform, you must create an account by verifying ownership of a valid Minecraft Java Edition account. By creating an account, you agree to the following:

  • You are solely responsible for maintaining the confidentiality and security of your account credentials
  • You are fully responsible for all activities and actions that occur under your account, whether or not authorized by you
  • You must notify us immediately at [email protected] of any unauthorized access to or use of your account
  • You must ensure that all account information you provide is accurate, current, and complete
  • You may not transfer, sell, or assign your account to any other person or entity
  • You may only maintain one account per Minecraft account; duplicate or alt accounts may be terminated

We reserve the right to suspend or terminate any account at our sole discretion, including for inactivity, suspected fraud, or violation of these Terms.

4. USER-GENERATED CONTENT

The Platform allows users to upload, publish, and share content of any format, including but not limited to texture packs, resource packs, ZIP archives and other binary files, thumbnails, screenshots, video clips and other audiovisual material, pack previews, descriptions, titles, tags, comments, reviews, profile images, banner images, links, community posts, and any other material you submit through any feature of the Platform (collectively, "User Content"). By submitting User Content to PacksMC, you:

  • Retain all ownership rights to your original User Content
  • Grant PacksMC a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully-paid, sublicensable, and transferable license to host, store, cache, reproduce, copy, transcode, re-encode, compress, resize, crop, trim, edit, modify, adapt, translate, create derivative works from, publicly display, publicly perform, distribute, redistribute, and otherwise use and exploit your User Content, in whole or in part, in any media and through any channel now known or later developed, in connection with operating, providing, promoting, and improving the Platform and our products and services. This license includes the right to generate previews, thumbnails, screenshots, clips, and other derivative renderings of your User Content; to convert pack files between game versions, formats, and resolutions; to feature your User Content in marketing, social media, advertising, and editorial contexts (including showcases, "Pack of the Week", changelogs, and email newsletters); and to allow end users to download, view, and interact with your User Content through the Platform
  • Acknowledge that this license survives any deletion or removal of your User Content, your account, or the Platform itself, but only to the extent necessary for legitimate operational, backup, legal-compliance, and historical-archive purposes. We will make reasonable efforts to honour deletion requests for actively-served public content
  • Represent and warrant that you own or have obtained all necessary rights, licenses, consents, and permissions from every contributor, collaborator, or third party whose work, likeness, voice, recording, image, trademark, or other protected material appears in or was used to create your User Content, and that you have the authority to grant the license described above
  • Represent and warrant that your User Content does not infringe, misappropriate, or violate any third party's intellectual property rights (including copyright, trademark, trade secret, and design rights), rights of privacy, rights of publicity, moral rights, or any other proprietary, contractual, or personal rights
  • Acknowledge that you are solely responsible for the legality, reliability, accuracy, originality, and appropriateness of all User Content you submit, and that PacksMC is not obligated to verify any of these representations before publishing your User Content
  • Agree to indemnify PacksMC for any third-party claims arising from your User Content as described in Section 16 below

Pack license declarations

When you upload a pack, you must select a pack license that tells other downloaders what they may do with your pack (e.g., "All rights reserved", "Free to use with credit", "Free to use — no redistribution", or a custom license described in your pack's description). The pack license governs the relationship between you and the downloaders of your pack; it does not override, limit, or modify the broader license you grant PacksMC under this Section 4, which is required for the Platform to function (e.g., to host your pack, to generate previews and screenshots, and to deliver files to downloaders). If a conflict arises between your stated pack license and the platform license in this Section, the platform license controls solely with respect to PacksMC's own operational use of your User Content.

Video clips and other media

The same license terms in this Section apply to any video clip, recording, gameplay footage, or audiovisual material you upload (including pack-preview clips, "in-action" videos, and any media you record using in-Platform capture tools). In particular, you confirm that any third-party music, voice, gameplay audio, branding, or footage embedded in your uploads is either yours or used with documented permission, and you authorise PacksMC to transcode, trim, watermark, generate stills from, and re-publish those clips in connection with the Platform.

We reserve the right, but have no obligation, to monitor, review, refuse, remove, take down, or restrict the visibility of any User Content at our sole discretion and without notice or liability to you, including User Content we believe in good faith may violate these Terms, applicable law, or any third party's rights.

5. PROHIBITED CONDUCT

You agree not to engage in any of the following prohibited activities:

  • Uploading, distributing, or transmitting any content that contains viruses, malware, trojans, ransomware, keyloggers, spyware, adware, executable files, or any other malicious or harmful code or software
  • Uploading content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, or otherwise objectionable
  • Impersonating any person or entity, or falsely claiming or misrepresenting your affiliation with any person or entity
  • Uploading stolen, plagiarized, or unauthorized copies of texture packs or other creative works belonging to third parties
  • Attempting to gain unauthorized access to the Platform, other user accounts, or any computer systems or networks connected to the Platform through hacking, password mining, brute force, or any other means
  • Interfering with, disrupting, or creating an undue burden on the Platform or the networks or services connected to the Platform, including through DDoS attacks, bots, scrapers, or automated access tools
  • Using the Platform for any commercial solicitation, advertising, or spam without our express written consent
  • Engaging in any activity that violates applicable local, state, national, or international laws or regulations
  • Circumventing, disabling, or otherwise interfering with security-related features of the Platform, including features that prevent or restrict use or copying of any content
  • Creating or distributing content designed to deceive or mislead users (e.g., fake downloads, phishing links, or bait-and-switch content)
  • Manipulating download counts, view counts, likes, or any other metrics through automated means or coordinated manipulation

6. CONTENT DOWNLOADS AND USER RESPONSIBILITY

PacksMC serves as a hosting platform for user-generated Minecraft resource packs and texture packs. By downloading any content from the Platform, you acknowledge and agree that:

  • All downloads are performed at your own risk, and you are solely responsible for any damage to your computer system, device, or data that results from downloading or using any content obtained through the Platform
  • PacksMC does not guarantee, verify, endorse, or assume responsibility for the safety, quality, accuracy, legality, or suitability of any User Content available for download
  • PacksMC is not responsible for any harm, loss, or damage caused by content uploaded by third-party users, including but not limited to files that may contain malware, viruses, unwanted software, or other harmful components
  • You should exercise caution and use appropriate security software when downloading and opening any files from the internet, including files from this Platform
  • PacksMC does not control and is not liable for how downloaded content is used after it leaves our servers

While we take reasonable measures to moderate content on the Platform, we cannot and do not inspect every file uploaded by users. If you encounter suspicious or harmful content, please report it to us immediately at [email protected].

7. PACKS+ AND COMMUNITIES+ SUBSCRIPTIONS

PacksMC offers optional paid subscription plans (“Packs+” and “Communities+”) that provide access to premium features. By subscribing, you agree to the following:

Free trial & automatic billing

New Packs+ subscribers receive a 7-day free trial. You must provide a valid payment method at signup. If you do not cancel before the trial ends, your payment method will be automatically charged the then-current subscription rate and your subscription will continue on a recurring basis until you cancel. By starting a trial, you expressly authorize this charge.

  • The free trial is offered once per user. Users who have previously held a Packs+ subscription (paid, trial, or otherwise) are not eligible for a new trial and will be charged immediately at checkout.
  • You may cancel during the trial at any time through your account billing portal at no cost. Cancellation made before the end of the trial period prevents any charge.
  • If you cancel during the trial, your subscription benefits remain active until the trial end date and are not extended into a paid period.
  • You will receive automated trial-ending reminders from our payment processor at the email associated with your billing account.

Recurring billing, cancellation & refunds

  • Subscriptions are billed on a recurring basis (monthly or as otherwise specified) through our payment processor, Stripe, until cancelled by you
  • You authorize us to charge your selected payment method at the then-current subscription rate on each renewal date
  • You may cancel your subscription at any time through your account settings or by contacting us; cancellation takes effect at the end of the current billing period
  • No refunds will be given unless required by applicable law
  • We reserve the right to modify subscription pricing, features, or benefits at any time with at least 30 days advance notice to active subscribers
  • Subscription benefits are personal to you and may not be shared, transferred, or resold
  • We reserve the right to revoke subscription benefits if we determine, at our sole discretion, that you are violating these Terms
  • Packs+ exclusive and private packs are for personal use only and may not be shared, redistributed, or made available to non-subscribers through any means. Sharing private packs is strictly prohibited and will result in immediate account termination (ban) without refund

8. COMMUNITY GUIDELINES

Users may create and manage communities on the Platform. Community owners and administrators are responsible for moderating their communities in accordance with these Terms and all applicable laws. We reserve the right to remove, restrict, or archive any community that violates our Terms, promotes harmful content, or fails to maintain appropriate standards of conduct. Community owners bear responsibility for the actions and content within their communities but may contact us for assistance with moderation issues.

9. INTELLECTUAL PROPERTY

The Platform and its original content (excluding User Content), features, functionality, branding, logos, design elements, and source code are and will remain the exclusive property of PacksMC and its licensors. The Platform is protected by copyright, trademark, trade dress, and other intellectual property laws of applicable jurisdictions.

"Minecraft" is a registered trademark of Mojang Studios AB. PacksMC is an independent community platform and is not affiliated with, endorsed by, sponsored by, or specifically associated with Mojang Studios AB, Microsoft Corporation, or any of their subsidiaries or affiliates.

10. DMCA AND COPYRIGHT COMPLAINTS

We respect the intellectual property rights of others. If you believe that any content on the Platform infringes your copyright, you may submit a takedown notice to [email protected] including the following information:

  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the infringing material and its location on the Platform (URL)
  • Your contact information (name, address, email, phone number)
  • A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
  • A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
  • Your physical or electronic signature

We will process valid takedown requests and may remove infringing content. Repeat infringers may have their accounts terminated.

11. THIRD-PARTY SERVICES

The Platform integrates with and relies upon various third-party services to operate. By using the Platform, you acknowledge that your use is also subject to the terms and privacy policies of these third-party providers. These services include, but are not limited to:

  • Payment processing and billing services
  • Cloud hosting and infrastructure services
  • Analytics and performance monitoring services
  • Advertising networks and services
  • User experience and behavior analytics services
  • Database and storage services
  • Content delivery networks

We are not responsible for the practices, content, or policies of any third-party services. Your interactions with third-party services are solely between you and the respective third party.

12. ADVERTISING

The Platform may display advertisements provided by third-party advertising networks. These advertisements may use cookies and similar tracking technologies to serve ads based on your browsing activity and interests. We are not responsible for the content, accuracy, or opinions expressed in any advertisements. Your interactions with advertisers, including any purchase or business transactions, are solely between you and the advertiser. PacksMC is not liable for any loss or damage of any kind incurred as a result of any such dealings or advertisements.

13. TERMINATION

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including but not limited to breach of these Terms. Upon termination: (a) your right to use the Platform will immediately cease; (b) we may delete or retain your account data and User Content at our sole discretion; (c) any outstanding fees or charges will remain due and payable; and (d) all provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

14. DISCLAIMER OF WARRANTIES

THE PLATFORM AND ALL CONTENT, MATERIALS, INFORMATION, SERVICES, AND PRODUCTS AVAILABLE THROUGH THE PLATFORM ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PACKSMC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT AVAILABLE ON OR THROUGH THE PLATFORM. YOUR USE OF THE PLATFORM IS AT YOUR SOLE RISK.

15. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PACKSMC, ITS OPERATORS, AFFILIATES, TEAM MEMBERS, MODERATORS, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE PLATFORM; (B) ANY CONTENT OBTAINED FROM THE PLATFORM, INCLUDING BUT NOT LIMITED TO ANY USER CONTENT DOWNLOADED FROM THE PLATFORM; (C) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM; (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; OR (E) ANY OTHER MATTER RELATING TO THE PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY US DOLLARS ($50), WHICHEVER IS GREATER.

16. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless PacksMC, its operators, affiliates, team members, moderators, and contributors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third party's rights, including intellectual property, privacy, or publicity rights; (d) any User Content you submit, post, or make available through the Platform; or (e) your negligent or willful misconduct.

17. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation between the parties. If a dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with applicable arbitration rules. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

18. SEVERABILITY

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

19. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any additional agreements you enter into with PacksMC (such as subscription agreements), constitute the entire agreement between you and PacksMC regarding the use of the Platform and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and PacksMC.
